This has allowed our team to participate in some of the most important technology and telecommunications infrastructure projects in Chile, as well as in large transactions on content exploitation rights in different media and platforms.

With respect to privacy and data protection, we offer comprehensive services ranging from the preparation and review of policies, adaptation of processes in companies required by the General Data Protection Regulation of the European Union, audits on regulatory compliance, processing of commercial information and credit scores, to the conduct of inventories and records of data activities.

The Technology, Privacy and Media team has vast experience in projects related to privacy and personal data protect ion, so we have extensive knowledge of the applicable legislation, as well as in the bill that is currently under discussion in Congress and seeks to replace the current law, and with the European regulations in this area, the General Data Protection Regulation (GDPR). Below you will find a summary of some of the projects on privacy and data protection that our team has led:

Google LLC

We have represented Google in multiple protection actions filed during the year 2020 based on the alleged violation of honor, privacy and the right to privacy and psychological integrity of individuals. In this context, we have obtained favorable rulings from the Supreme Court, upholding the criterion that Internet intermediaries should not be held liable.

Banmédica

Our firm continuously advises Banmédica on issues related to the treatment of personal data and information security. For example, we advised Banmédica regarding the Information Security Policy applicable to its relationship with potential suppliers. The advice consisted in the revision of the Security Annex, focusing especially on the protection of information, such as personal and sensitive data, the security of its databases, as well as the intellectual property of such databases.

Arauco

Our team regularly advises Arauco in multiple areas, including privacy and data protection. Recently, at the client’s request, we conducted an exhaustive analysis of the current Chilean law on this matter, the bill currently under discussion and the European General Data Protection Regulation, which was finally translated into a comparative table between the three bodies of law.

KPMG Chile

Currently, our firm, in alliance with KPMG, is advising companies such as Banco Santander, Coopeuch and Zurich Chilena Consolidada, with a detailed review of their processes, products and services involving the processing of personal data. The audit services include the review of the companies’ technological systems, the privacy and data protection measures applied to their processes, among other matters, in order to propose corrective measures to adapt to the future new data protection regulations.
